Twenty-nine persons including pastors have been dragged to Court for illegally occupying over seven hundred acres of land situated in the Omega Community, Paynesville City.
Some of accused occupants are Pastor Abraham Sheriff, Pastor Roosevelt Sumowah, Edward Liberty, Nat Roosevelt, John Tokpah, Jones Govese, Hallie Zayuah, Grant Bolay, Abraham Johnson, Nathaniel Roosevelt, Daniel Kollie, Helena Robert, Nathaniel Gamue and Josey Saye, among others.
The land in question is the Intestate Estate of Gbarbour, Kpawee, Ballah and Nappy by and through its administrators Nathaniel Ballah and T. Ernest Tekpee.
The administrators’ lawyer Counselor Augustine Fayiah accordingly filed a nine-count action of ejectment against the 29 occupants at the Civil Law Court seeking to evict them from the property, consistent with Chapter 62, Section 62.1 of the Civil Law Procedure Law of Liberia.
The law states: “Any person who is rightfully entitled to the possession of real property may bring an action of ejectment against any person who wrongfully possesses thereof”.
Earlier, the Plaintiff and defendants appeared before the Land Commission where the Land Authority ordered an investigative survey, but the process was reportedly undermined by the alleged failure of the defendants to submit to the survey.
Our Judicial Correspondent further revealed that as a result of Plaintiffs’ legal action, Civil Law Court Resident Judge Kennedy Peabody has issued a Writ of Summon for the illegal occupants to appear in Court in order to respond to the plaintiffs’ claims against them or risk default judgment.
In a related development, lawyers representing the 29 persons have filed an application to the Civil Law Court pleading the Civil Law Court for enlargement of time in order to prevent their clients’ eviction from a seven hundred acres of land situated in the Omega Community, Paynesville City.
But the legal Counsellor representing the Interstate of Gbarbour Kpwee through its administrators Wednesday filed a seven-count motion, in response to a motion for enlargement of time to file the defendants’ lawyer at the Civil Law court.
Responding, Cllr. Augustine Fayiah said all legal counsels were served with copies on three separate dates in August, indicating that they are deceiving the court.
Cllr. Fayiah further said, this is not applicable in court, noting that the remedy for enlargement of time prayed for to the court should be dismissed and quashed.
