TARGA Prepares Lawsuit Against Corrupt, Deposed TAPA Leadership -Hails Sahr, Nagbe for Faulting, Quashing Prohibition Writ

MONROVIA – The Tarjuowon Global Alliance (TARGA) says it congratulates all progressive forces of Tarjuowon based  both on the homeland and in the diaspora, for their steadfast and heroic stance against the deposed Ayatollah regime of the Tarjuowon People’s Association (TAPA) and all its surrogates in the last few weeks.

The group, in a release issued in Monrovia, particularly takes note of the legal support of two erudite lawyers – Attorney Elijah Sahr and Attorney Joseph Nagbe – for their faultless and robust legal response on behalf of the people to the ill-fated and flawed writ of prohibition issued by the chronically corrupt former TAPA leadership on the May 14 elections.

While the motive of Ayatollah Andrew N.  Jaysay Sr., former TAPA Chairperson, is to use the prohibition writ to camouflage his years of ineptitude, tyranny and broad-day robbery, it rather fortunately plays out well for the Tarjuowon people, as the writ sheds more light on how deep his criminal and greedy attitudes have long destroyed the organization.

TARGA, in a release signed by its National Coordinator March Q. Sahr, also thanked counsels Sahr and Nagbe who, based on operating laws of the country, described in our return the Jaysay probation writ as “nothing but a legal nullity or an effort in futility, in that the motion for injunction is an ancillary suit that must grow out a main suit, which is not the case in this instant matter” and therefore ask the Court to quash it.

Deeply defective ‘writ’

As the two ace legal minds of Sinoe County rightly argued, the writ is grossly legally flawed, lacking all the elementary ingredients of a “writ of prohibition”.

For instance, according to the two counsels, the cabal of the Ayatollah’s “action is not initiated by authorized officers of the Tarjuowon People’s Association but by private individuals, in their private names, in contravention of controlling laws in this jurisdiction” and that “there is no party before this Honourable Court named Tarjuowon People’s Association. Rather, it is the Republic of Liberia along with the other named Petitioners herein that instituted this action in blatant violation of extant laws.”

In further denigration and pillage of the so-called writ of prohibition, counsels Sahr and Nagbe said, “the preliminary injunction filed against movants is without a main suit, and because an ancillary action must be premised on a main suit, the action for injunction cannot lie.”

TARGA Prepares for Counter-Suit

TARGA further says, the admittance on the records by Ayatollah Jaysay Sr.,  to convert the Tarjuowon people’s grassroots organization for development, peace and unity into a personal venture is criminal, unlawful and sinister, paving his way for criminal prosecution in the court of law.

“The unrepentant Ayatollah will have to account through a recognized court of the Republic where he got the mandate and latitude from to criminally turn the people’s organization into a private entity, stealing the people’s brand and patent which is Tarjuowon People’s Association (TAPA),” said Pastor Morris Manneh, a stanch stalwart and member of the citizen group that is  preparing the law suit.

He added: “Jaysay has long been duping a lot of Liberians, including Tarjuowon people, and he has set a trap that will not only intercept him but harshly punish him.” “Our memories are still fresh about his involvement in cars scandals some years ago, when he collected monies from innocent people under the guise of a dealer.” He squandered the people’s monies which led to his incarceration in the Monrovia Central Prison for months. It can also be recalled, when he served as superintendent of Tarjuowon Statutory District, Ayatollah Jaysay, Sr., embezzled salaries valued thousands of dollars of local government workers, which was why he was shamefully removed.

The release noted further: “Our memories are still fresh when this self-proclaimed Bishop duped some white investors in Tarjuowon when he tricked the people into believing that he was in agricultural activities. He went on the net and took photos of impressive farms and sent them to the investors. The investors were excited about the outlooks of the farms and pumped thousands of United States Dollars to buttress the efforts without knowing that the self-proclaimed Bishop was on a 419 mission”.

Jaysay was caught pants down when the investors visited him and asked to see the farms but he shamelessly took the people around in the bushes without showing any of the farms. He later intimidated the investors under the pretense that there is a devil in the area that doesn’t like “white people” which forced the investors to leave Tarjuowon in frustration.

Here he goes again—admitting on the records that he has criminally converted TAPA into his private entity, and singlehandedly receiving and pocketing thousands of US Dollars and resources intended for the people. His fate is sealed.

Tarjuowon Elders’ Intervention

TARGA asserts that it was Ayatollah Jaysay Sr., himself, who has chosen the terms and conditions of the current fight in the district; it is he who has chosen to go to court – taking fellow Tarjuowon citizens to Court – while elders in the district had already asked for a hold on the May 14 elections, and their appeal was granted before he filed his suit.

While TARGA appreciates the elders’ recent statement issued on the current state of affairs in Tarjuowon, in which amongst other things, they refreshed memories of consensus reached by fallen elders of TUDA restraining fellow citizen from taking a fellow Tarjuowon person to court, we want to make it clear that it was Ayatollah Jaysay Sr., who has broken the rule, who has taken himself to the legal slaughterhouse, and we will not relent to give him what he calls for, and deserves.

TARGA welcomed the insistent position of the elders that elections are the most logical pathway of the crisis, and we pledge all our support and recourses to achieving that.

“However, we will make it clear categorically that elections will not be a cover-up for the imperative need for accountability; that those who pillaged the resources of the district, who stole the people’s organization into a personal venture, will not go with impunity. And we are determined to pursue that legally,” the group said in the release.
